Cleanroom contractor in Ecuador: rules for buyers

Which rules apply to your facility

ARCSA-DE-008-2018-JCGO, signed on 15 May 2018 and published in Registro Oficial 257 on 7 June 2018, is the sanitary technical regulation on BPM for pharmaceutical laboratories (gob.ec). For a national laboratory the BPM certificate is valid for three years. The application includes a BPM verification guide, a site master file, a georeferenced location sketch and a validation master plan with records of at least six months. ARCSA technical staff carry out the audit (ARCSA procedure page, gob.ec, updated 11 October 2023).

ARCSA also certifies foreign laboratories at the request of applicants or holders of a sanitary registration for medicines. It audits the foreign laboratory after payment and a planning meeting, and the certificate is valid for three years (ARCSA procedure page, gob.ec, updated 24 December 2024). ARCSA's 2026 regulatory plan schedules an update of the BPM norm for medicines for November 2026 (Lexis Ecuador, 28 April 2026).

For hospitals, ACESS issues the operating permit of public and private health establishments in the National Health System. It is valid for one calendar year, and the service portfolio is presented during an on-site inspection (ACESS procedure page, gob.ec, updated 15 January 2026).

Who builds cleanrooms here

National pharmaceutical laboratories and health establishments are the regulated buyers. A foreign laboratory that needs an ARCSA certificate is a third group.

What a foreign contractor must arrange

Article 415 of the Ley de Compañías says a company formed abroad that will carry on activities habitually in Ecuador must prove it is lawfully constituted, keep at least one representative with broad powers permanently in Ecuador, and set up capital in Ecuador for the activity. A foreign representative must be a resident under article 416. The filing goes through the Registro Mercantil and DINARP, with protocolised foreign documents that include a power of attorney (gob.ec DINARP page, updated 19 September 2025). Ask Ecuadorian counsel whether one contract counts as habitual activity.

What to send for a first scope

Send the room list with the ISO 14644-1 class and occupancy state for each room. Add floor plans and ceiling heights. State whether the rooms are for an ARCSA BPM certificate or an ACESS permit, whether they are sterile or non-sterile, and name the province.
